HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7072 OF 2018 O R D E R :

The case of the petitioner is that when he was working as Village Administrative Officer at Pidched Village of Gajwel Taluk, Medak District, the 3rd respondent kept the petitioner under suspension on the ground that he involved in a criminal case bearing No.137/2004, booked under Sections 306, 398(A), 494, IPC vide proceedings No.A3/VS/1525/2008, dated 04.03.2008, since petitioner was sentenced for rigorous imprisonment of 10 years along with a fine of Rs.5,000/- by the Sub-Court, Siddipet. Petitioner was lodged at Cherlapalli Central Prison, Hyderabad. Thereafter, on appeal, the said sentence was suspended and the petitioner reinstated into service and had continuously worked as the Village Administrative Officer and retired on 30.04.2013 on attaining the age of superannuation i.e.

58 years and was permitted to retire from his service through proceedings dated 24.06.2014 issued by the 3rd respondent. Thereafter, the Criminal Appeal No.30 of 2008 filed by the petitioner was allowed on 09.08.2016 setting aside the conviction and sentence and the petitioner made representation to the 7th respondent and also to 3rd respondent for release of pension and other pensionary benefits, outstanding amounts of salary including suspension allowances and all other eligible terminal benefits.

respondent forwarded the case of the petitioner to 2nd respondent vide proceedings dated 15.11.2017, and again the 2nd respondent had referred the matter to the 1st respondent on 20.12.2017. As no action is being taken, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services.

Since the grievance of the petitioner is already pending before the respondents, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to consider the representation of the petitioner for sanction of pension and other pensionary benefits, outstanding amounts of salary including suspension allowances and all other terminal benefits, in accordance with law, and pass orders within a period of four months from the date of receipt of a copy of this order. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 27.03.2018 t k.
