THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE S.V.BHATT WRIT APPEAL No.972 of 2017 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) On the merits of the Writ Appeal, we see that the order sought to be challenged was issued by the learned single Judge on 11.05.2017. That matter related to the request of two writ petitioners to write examinations of the third year second semester of BE/B.Tech course. The learned single Judge issued an interlocutory order granting such relief only to the first writ petitioner. This Writ Appeal is by the second writ petitioner.

With the passage of time, there is no question of permitting the appellant to seek any relief in relation to the examination, which was subject matter of the interlocutory order.

Hence, preserving the contentions of the appellant in the Writ Petition, provided that is still pending, this Writ Appeal is dismissed without entering on the merits and the contentions touching the claim of the appellant for admission to the examination.
