THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.1297 OF 2011 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the respondents in denying the payment of the land value of the building bearing municipal Nos.16-1-553/24/1 and 16-1-553/25 to 29, situated at Saidabad, Hyderabad, demolished for road widening and compensation and rental value as claimed in the representations dt. 24-11-2008, 03-02-2010 and 01-11-2010 submitted by the petitioner, by setting aside the impugned Letter No.437/ACP/C4/GHMC/2010 dt.24-12-2010 issued by the 2nd respondent and consequently direct the respondents to pay the land value, compensation and rental value as per the said representations of the petitioner, in the interest of justice."

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that vide impugned letter, dated 24.12.2010, the respondent Corporation rejected his representations, dated 03.02.2010 and 01.11.2010, without properly assessing the land value of the building in question and the damages caused to him and that the same was issued without assigning any reasons.

Considering the facts and circumstances of the case, the petitioner is directed to make a fresh representation to the respondent Corporation on or before 25.03.2017 incorporating his grievances and on such representation being made, the respondent Corporation shall appoint a Surveyor to take the measurements of

the property in question and conduct proper enquiry and thereafter, dispose of the said representation in accordance with law within a period of three (3) months.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
