THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8558 of 2019 O R D E R:

The petitioner claims to be the owner of a residential house bearing No. 647/1/1/5 admeasuring 70 square yards under Malkajgiri Municipality limits. Her case is that she started raising one room above the existing ground floor, but without obtaining permission under the impression that no such permission is necessary since the property is in less than 100 square yards. While so, the 3rd respondent came to the subject property and threatened to demolish the structure on the ground that she did not obtain any permission. Though the petitioner tried to convince the authorities, they did not heed her request. Hence, the Writ Petition. Heard learned counsel for the petitioner.

Sri Chatla Madhu, learned Standing Counsel for the Corporation submits that they will follow the necessary procedure prescribed in law while dealing with the construction raised without obtaining permission therefor.

In view of the said submission, it is directed that the respondent authorities shall not undertake any demolition of the petitioner's property, without following due process of law and without observing the principles of natural justice. With this order, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
