THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20596 of 2017 ORDER:

This Writ Petition is filed by the fair price shop dealer of shop No.35 of Kammavaripalli Village, Kolimigundla Mandal, Nandyal Division, Kurnool District, challenging the order dated 05.05.2017 passed by the third respondent terminating the dealership of the petitioner. The petitioner preferred an appeal on 16.05.2017 to the second respondent along with an application seeking stay of the said proceedings.

Learned Counsel for the petitioner submits that out of the five charges leveled against the petitioner, only two charges which are trivial in nature were proved, and though the appeal is pending, the petitioner is entitled to continue the dealership. In view of the pendency of appeal and the stay application, this Court is not inclined to entertain the present Writ Petition, but directs the second respondent to consider the stay application filed by the petitioner and pass appropriate orders thereon in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of.
