HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.27836 of 2013 ORDER:

There is no representation on behalf of the petitioners. The prayer sought in the writ petition is as under: "... to issue a writ or order more particularly one in the nature of writ of Mandamus declaring the action of the 1st respondent at the instigation of 2nd respondent in harassing and interfering with the peaceful possession and enjoyment of the petitioners land in survey No.337 of Khanapuram Haveli Khammam Urban Mandal, Khammam District admeasuring approximately 400 sq. yards as illegal, arbitrary, unjust and also against Article 300-A of Constitution of India and consequential directions to the respondents not to interfere with the peaceful possession and enjoyment of the petitioners land in survey No.337 of Khanapuram Haveli, Khammam Urban Mandal, Khammam District."

Learned Government Pleader appearing for the 1st respondent placed on record written instructions dated 11.11.2019 issued by the Inspector of Police, Khanapuram Haveli Police Station.

From a perusal of the said written instructions it is revealed that the 1st respondent is not harassing the petitioners and interfering with their peaceful possession and enjoyment of the land in Sy.No.337 of Khanapuram Haveli, Khammam. No complaint was received by the 1st respondent against the petitioners and no crime was registered against them. Therefore, there is no necessity for the 1st respondent to interfere with the peaceful possession and enjoyment of the subject land of the petitioners. Neither the petitioners nor the 2nd respondent approached the 1st respondent police and they were never called to Khanapuram Police Station in relation to the land issue. In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
