O R D E R

This writ petition is filed to declare the proceedings of the 2nd respondent - Commissioner and Inspector General of Registration and Stamps, Government of Andhra Pradesh, in draft Memo No.G2/19134/2011 dated 1.12.2011 as illegal and without jurisdiction and consequently direct the 4th respondent - Sub Registrar, to receive and register the document presented by the petitioner in respect of subject property in the writ petition without reference to the said memo dated 1.12.2011. Both the counsel submits that in similar facts and circumstances, considering the very same memo No.G2/19134/2011 dated 1.12.2011 issued by the 2nd respondent - Commissioner, this court in W.P.No.26527/2016 dated 27.8.2016, disposed of the writ petition with the following direction:

"For the reasons alike, this writ petition is also allowed setting the Memo No.G2/19134/2011 dated 1.12.2011 issued by the 2nd respondent. There shall be a consequential direction to the Sub-Registrar, Podili, to receive and process the documents presented by the petitioner in respect of the subject property without reference to the order dated 15.3.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010. In the event, the document presented are found to fulfil the requirements of the Registation Act, 1908 and the Indian Stamp Act, 1899, the Sub Registrar Podili, shall complete the registration formalities and release the documents in accordance with due procedure. No costs."

In view of the above, the present writ is also allowed in terms of the above directions of this court in W.P.No.26527/2016 dated 27.8.2016. No costs. Miscellaneous petitions pending if any, shall stand closed. AVS ------------------------------------- 30-09-2016
