THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7020 OF 2018

ORDER

This Writ Petition is filed for the following relief: "to declare the action of the 3rd respondent in not releasing the Tractor & Rotovator to the petitioner, which was sanctioned to her under RKVY scheme, as illegal and arbitrary, consequently direct the 3rd respondent to release the Tractor and Rotovator to the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

It is submitted by the learned counsel for the petitioner as well as the learned Government Pleader for Agriculture appearing for the respondents that the issue in the present Writ Petition is squarely covered by the order, dated 16.02.2018 passed by this Court in Writ Petition No.4954 of 2018 and the said order is placed on record.

Operative portion of the aforesaid order is extracted as follows:

"The case of the petitioner is that he had fulfilled all formalities and that similarly-situated persons were already released the vehicles. In that factual backdrop, the 3rd respondent is directed to take necessary steps to complete the enquiry, if not done already and ensure that the tractor bearing No. 20 PTO HP & Rotovator is released in favour of the petitioner, who was granted subsidized loan, within a period of two weeks from today. In default, the 3rd respondent shall be liable to indemnify the loss that may be caused to the petitioner due to nonrelease of the tractor. The Writ Petition is accordingly, disposed of. No costs." Following the aforesaid order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
