O R D E R

This petition is filed under Section 438 of Cr.P.C. seeking release of the petitioners who are A2 , A-3 and A-5 on bail in the event of their arrest in connection with PRC.No.19/2015 on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the respondent - State. From the material on record it could be seen that the crime was registered in the year 2013 and charge sheet has been filed against the accused A-1 to A-5 for the offences punishable under Sections 498-A, 325, 3-4-B read with 34 IPC. As per the averments of the petitioners, the accused No.1 was in judicial custody for ninety days and was released on mandatory bail and accused No.3 obtained anticipatory bail from this court in Crl.P.No.14153/2013. Now the proceedings are at the stage of PRC. Since 2015, the police could not arrest petitioners 1 and 3 / A-2 and A-5. Further, the warrants issued in PRC against the petitioners are pending execution since 7.5.2015.

Having regard to the above circumstances and without going into the merits of the case, the criminal petition is disposed of directing the petitioners 1 and 3 / A-2 and A-5, to appear before the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad and make an application seeking bail and recall of the warrant issued. In which event, the same shall be considered on such terms and conditions, as the court deems fit and proper. It is needless to mention that the petitioners shall appear before the court regularly without fail and in default, the Court concerned shall take appropriate steps in accordance with law.

Miscellaneous petitions pending if any, shall stand closed.
