This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by petitioners/A.1 to A.3 seeking anticipatory bail in connection with FIR No.50 of 2026 of Sadasivpet, Sangareddy District. The offences alleged against the petitioners are under Sections 318(4), 316(2), 351(2), 351(3) of Bharatiya Nyaya Sanhita, 2023. 2.

The facts of the case are that the defacto complainant lodged report before police stating that the petitioners herein

- 2 - entered into an agreement with complainant for transactions involving development of land and sale of land and a Memorandum of Understanding dated 15.08.2024 was entered between the parties for total consideration of Rs.20 Crores and subsequently, the company paid huge amount of money through various payment including cash towards development and after survey and demarcation of the land, they came to know that the land is only Ac.11.38 and the accused entered into MOU with an intention to cheat the complainant and after receiving the amount they also threatened him. As such, requested the police for necessary action basing on the same police registered the case against the accused. 3.

Heard Ms. Devineni Radha Rani, learned counsel for the petitioners and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent. 4.

The contention of learned counsel for the petitioners is that the present crime is registered only as a counter blast to the earlier crime registered against the complainant in FIR No.361 of 2025 wherein this Court granted anticipatory bail to the defacto complainant on the ground that matter is civil in nature and this petitioner is no way connected with the alleged

- 3 - forgery or cheating. In fact petitioner herein is the victim in the hands of complainant. Therefore, requested this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the alleged offences are serious in nature as such, petitioners are not entitled for bail and prayed this Court to dismiss this criminal petition. 6.

Considering the submissions made and the material placed on record, there is litigation pending between the parties. The petitioners herein also filed writ petition requesting the Court to direct the registering authority not to entertain registrations without approval of RERA and thereafter criminal case is filed against the complainant and subsequently also criminal cases are filed against the complainant. Considering the series of litigation between the parties which is civil in nature, this Court deems it fit to grant anticipatory bail to the petitioners subject to the following conditions : i.

The petitioners shall surrender before the Station House Officer, Sadasivpet Police Station, Sangareddy District within two weeks from today, and on such surrender, the said Station House Officer shall

- 4 - release the petitioners on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioners shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.

iii.

The petitioners shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, Criminal Petition is allowed.
