HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44360 of 2016 ORDER:
The present writ petition is filed by the petitioner, seeking to declare the action of the respondents 1 to 4 in not arresting the 5th respondent in connection with FIR No.222 of 2016 on the file of Kethapalli Police Station, for the offence under Section 3 (1) (r) (s) of SCs & STs (PoA) Act as illegal and arbitrary and consequently, direct the respondents 1 to 4 to arrest the accused.
Heard and perused the material available on record. The main grievance of the petitioner is that basing on the complaint, dated 16.11.2016, lodged by him before the 4th respondent against the 5th respondent, who abused the petitioner in the name of his caste, Crime No.222 of 2016 was registered. But the police did not choose to conduct investigation.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: The respondents 2 to 4 are directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
