THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.1373 of 2017 ORDER: (per SK,J) This writ petition was filed assailing the e-auction sale notice dated 03.12.2016 issued by the Vijaya Bank, Hyderabad, the second respondent, proposing to hold the auction of the secured asset on 19.01.2017. It is now represented by Sri M.Ramalingeswara Reddy, learned counsel for the petitioner, that the auction sale proposed to be held on 19.01.2017 did not materialise for want of bidders. That being so, the challenge to the e-auction sale notice dated 03.12.2016 is rendered purely academic and does not require adjudication on merits.

The writ petition is accordingly dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law as and when a fresh cause of action arises. All issues are left open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
