THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20842 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of Shop No.34, Pulaguttapalli Village, Guntakal Mandal in Anantapuram District. Based on the report submitted by the Tahsildar, Guntakal Mandal, dated 09.06.2015, a show cause notice was issued to the petitioner on 15.06.2015.
The petitioner submitted his explanation through his Advocate on 20.06.2015. Having not satisfied with the said explanation, the second respondent suspended the authorisation of the petitioner, by order dated 01.07.2015. Challenging the same, the present Writ Petition is filed.
Though there are five charges levelled against the petitioner, charge No.1 relates to variation in the stock. The substance of the charge is that the ground balance did not tally with the balance as per EPos. Though the other charges are only technical in nature, the first charge requires enquiry.
In the circumstances, this Court is not inclined to interfere with the enquiry process at this stage. The second respondent is directed to conduct enquiry in accordance with law and complete the same within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
