HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41025 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 3rd respondent to act upon her complaint dated 1.10.2016.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the 4th respondent borrowed amount from the petitioner and when the petitioner asked the 4th respondent for repayment of the same, she has been postponing the same. On 30.9.2016, when the petitioner went to the house of the 4th respondent, the unofficial respondents abused her in filthy language and assaulted her and threatened her with dire consequences. On 1.10.2016, respondents Nos.4 to 6 along with some others came to the house of the petitioner and assaulted her mercilessly. The petitioner lodged a complaint on the same day. But no action has been taken so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion, the Writ Petition is disposed of with the following direction:

"The 3rd respondent is directed to register a case on the basis of the complaint of the petitioner, if it discloses any cognizable offence and proceed in accordance with law. If the 3rd respondent fails to register a case, she is at liberty to approach the superior officers or to avail the remedies that are available under the Code of Criminal Procedure."

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
