THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20577 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner is a rice miller. He has obtained food grain license and has been conducting operation for the last 6 months. While so, on 08.05.2015, the third respondent along with other officials, inspected the rice mill of the petitioner and found some variation in the registers and non-compliance of the license conditions.

They conducted a panchanama and 6-A proceedings were initiated against the petitioner. The present Writ Petition is filed seeking release of the seized stock pending 6-A proceedings.

In view of the relief sought in the present Writ Petition, as urged by the learned counsel for the petitioners, the seized stock shall be released to the petitioner, as and when the petitioner furnishes bank guarantee for the value of the seized stock i.e., Rs.3,96,150/-. In the meanwhile, the respondents shall not sell the seized stock.

The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
