This Criminal Petition is filed under Sections 485 (1)(b) read with 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking to relax the condition imposed in the order, dated 16.12.2025 passed in Crl.M.P.No.01 of 2025 in Crl.A.No.102 of 2025 on the file of learned Judge, Family Court-cum-IV Additional Sessions Judge, Khammam, wherein the petitioner was directed to deposit 20% of the compensation amount i.e., Rs.1,20,000/- on or before 16.01.2026, failing which the

- 2 - petition shall stand dismissed. Challenging the same, the present petition is filed.

Heard Mr.Sandeep Kumar Bodla, learned counsel for the petitioner. Perused the record.

Learned counsel for the petitioner would submit that the learned Judge, Family Court-cum-IV Additional Sessions Judge at Khammam, vide order, dated 16.12.2025, in Crl.M.P.No.01 of 2025 in Crl.A.No.102 of 2025, suspended the sentence imposed against the petitioner vide judgment, dated 17.11.2025 in C.C.No.3054 of 2019, on condition of petitioner depositing 20% of the compensation amount i.e., Rs.1,20,000/-. He further submits that the petitioner is a senior citizen and he is unable to pay the said amount and therefore, the petitioner requested the Court to reduce the same to 10%. In support of his contentions he also placed reliance on the Judgment of the Hon'ble Supreme Court in Jamboo Bhandari v. M.P. State of Industrial Development Corporation Limited1.

Having regard to the submissions made by the learned counsel for the petitioner and taking into 1 (2023) 10 SCC 446

- 3 - `consideration the decision of the Hon'ble Apex Court, the petitioner is directed to deposit compensation of 10% instead of 20% as directed by the learned trial Court, within a period of one month from the date of receipt of a copy of this order. The other conditions imposed by the learned trial Court shall remain un-altered.

With the above observations, the Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending shall stand closed.
