THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.5659 of 2016 ORDER:

This Civil Revision Petition is filed questioning the Order dated 02.09.2016, passed by the learned Senior Civil Judge, Kavali, in R.C.A.No.1 of 2012.

2) The petitioner is a tenant. The Rent Controller allowed the R.C.C. No.2 of 2008 filed by the landlord and the same was also confirmed by the appellate authority.

3) Learned counsel for the petitioner after arguing for some time had indicated that if breathing time is granted the petitioner would vacate the schedule premises and handover the vacant possession. Accordingly, considering the said submission this Court by an order dated 02.12.2016, taking into consideration of the consent of the learned counsel for the respondent-landlord, gave liberty to the petitioner to file an undertaking before this Court setting out the time within which he would vacate the tenanted premises. Accordingly, an undertaking dated 06.12.2016 is filed under U.S.S.R.No.7548 of 2016, whereunder the petitioner had undertaken to vacate the tenanted premises on or before 31.06.2017. Undertaking is taken on record.

4) Accordingly, this Civil Revision Petition is closed in terms of the undertaking of the petitioner, permitting the petitioner to continue in possession of the tenanted property and he shall vacate the same on or before 31.06.2017 by handing over the vacant possession. The petitioner shall be conscious that violation of the undertaking would amount to contempt of the court.

5) Accordingly, this Civil Revision Petition is closed. However, the petitioner is granted four weeks time for payment of arrears of the amount ordered by the Court below along with the costs. There shall be no order as to costs.
