HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.2276 of 2014 ORDER:

This revision is filed against the order dated 18-092014 passed in Crl.A.No.780 of 2014 by the Metropolitan Sessions Judge, Hyderabad, confirming the order dated 28-07-2014 passed in Crl.M.P.No.754 of 2014 in Crime No.503 of 2014 (Banjara Hills Police Station) by the Special Judicial First Class Magistrate for Excise Cases, Hyderabad, whereby the plea of the petitioner is rejected and the Court refused to allowed the victim girl to be with the petitioner herein.

Brief facts of the case are as follows :

The victim rescued from the prostitution house and subsequently ordered to be in rescue home for a period of two years. Subsequently, the mother filed an application for production of the girl and also she filed an affidavit that she will take care of the victim girl. The trial Court as well as the appellate Court refused to grant the relief as prayed for.

The victim girl has already suffered in the rescue home for a period of 1 1⁄2 years. Originally her custody was given to the rescue home for a period of two years. It is the case of the petitioner that the victim girl is suffering with ailments and that necessarily mother has to take care of her and to treat her properly.

Considering the same and also the period the victim girl suffered in the rescue home, authorities concerned are directed to hand over the victim girl to the petitioner herein on her execution of an affidavit that she will produce the girl before the concerned authorities as and when required by the authorities.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, in this revision are closed.
