THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.445 OF 2017 ORDER:

This criminal petition is filed for modification of the order passed in Crl.M.P.No.3916 of 2016 in Crl.M.P.No.3351 of 2016 in Crime No.52 of 2016 on the file of Metropolitan Sessions Judgecum-I Additional District & Sessions Judge, Visakhapatnam District, where the Sessions Judge enlarged the petitioner on bail, directing him to furnish personal bond of Rs.1,00,000/- (Rupees one lakh only). Now, the present criminal petition is filed to relax the same condition and to direct the petitioner to furnish security for the said amount.

Taking into considering the facts and circumstances of the case, imposing an onerous condition strictly amounts to burden. However, taking into consideration the nature of the offence, I deem it appropriate to modify the order directing the petitioner to deposit a title deed of immovable property worth more than Rs.50,000/- with the Metropolitan Sessions Judge-cumAdditional District & Sessions Judge, Visakhapatnam District. It is made clear that the other conditions imposed by the Metropolitan Sessions Judge-cum-I Additional District & Sessions Judge, Visakhapatnam District, in Crl.M.P.No.3916 of 2016 in Crl.M.P.No.3351 of 2016 in Crime No.52 of 2016 shall remain in force.

With the above modification, the criminal petition is allowed. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed. No costs. _________________________________________ JUSTICE M. SATYANARAYANA MURTHY Date:31.01.2017 SP
