THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No.9520 OF 2015 ORDER:
The petitioner has been placed under suspension on 23.07.2014 by the 5th respondent - Society. It is now brought out by the learned counsel for the petitioner that in the criminal case, that was also simultaneously booked against the petitioner in Crime No.98 of 2014 under Sections 153-A and 295-A IPC by the Cherla Police Station in Khammam District, charge sheet has already been filed. Consequently, the prospects of the petitioner herein gaining access to the record or seeking to influence the witnesses would not, perhaps, arise. Therefore, it is only appropriate that the order passed placing the petitioner under suspension deserves to be reviewed by taking all relevant facts and pass appropriate orders thereafter, as prolonged suspension of an employee is not going to help the cause any further.
The purpose of placing the employee under suspension is only to enable the enquiry to be conducted in a fair and impartial manner, it would also help the employee from not tampering the evidence and not influencing the witnesses, who are willing to speak against him. Therefore, the order of suspension passed on 23.07.2014 against the petitioner be reviewed as expeditiously as possible preferably within a period of six (6) weeks from the date of receipt of a copy of this order and decision taken thereon be communicated to the petitioner.
With this, the writ petition stands disposed of after hearing the learned Assistant Government Pleader for Co-operation. No order as to costs.
