O R D E R
The grievance of the petitioner in this case is as to the alleged inaction on the part of the police authorities in registering an offence upon her complaint dated 12.09.2014.
Written instructions dated 10.12.2014 were furnished by the Inspector of Police, Saroornagar Police Station, Cyberabad, to the office of the learned Government Pleader for Home, wherein he stated that upon receipt of the petitioner's complaint through post, a Constable was deputed to the address shown by the petitioner in the said complaint, but she was not found at the said address. As the whereabouts of the petitioner were not known, the Inspector stated that the police authorities could not record her statement.
In the light of the afore-stated stand of the police authorities, Sri P.Narasimhulu, learned counsel for the petitioner, fairly stated that his client may be given an opportunity to file a fresh complaint in accordance with the due procedure.
The writ petition is accordingly disposed of permitting the petitioner to make a fresh complaint to the police authorities as per law. Needless to state, in the event such a complaint is made, the police authorities are bound to act thereupon in accordance with the directions of the Supreme Court in LALITA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH[1].
Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
