THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.1896 of 2017 ORDER:

This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioners/A.3 and A.5 on pre-arrest bail since they are apprehending arrest in connection with Crime No.20 of 2017 of Tiruchanur Police Station, Tirupathi Urban Police Station, registered for the offences punishable under Sections 324 r/w 34 IPC and Section 3 (i) (x) of SCs and STs ( POA) Act, 1989 ( as amended 2015).

After arguing the matter for a while, learned counsel for the petitioners requested this Court to permit the petitioners to surrender before the Special Court for trial of offences under SCs and STs (POA) Act.

Acceeding to the request of learned counsel for the petitioners, without going into the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Court for trial of offences under SCs and STs (POA) Act and on such surrender, if any application is filed under Section 437 and 439 of Cr.P.C, after serving notice on the Public Prosecutor, the Presiding Officer of the concerned Court is directed to decide the application filed by the petitioners on the same day in accordance with law.

With the above observation, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
