THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.8674 OF 2019 ORDER:
The prayer of the petitioners, 75 in number, is to declare the action of the revenue authorities in not issuing them pattadar passbooks in relation to various extents of land in different survey numbers of Morampally Banjar Village, Burgampahad, Bhadradri Kothagudem District, as illegal and to consequently direct the said authorities to do the needful.
It appears that the petitioners are claiming rights over the subject lands on the strength of the judgment and decree dated 30.11.1967 passed by the learned Subordinate Judge, Khammam, in O.S.No.94 of 1963, which was confirmed in appeal by the High Court, by judgment and decree dated 28.02.1973, in A.S.No.370 of 1968. However, it may be noted that in terms of Section 4 of the Telangana Rights in Land and Pattadar Passbooks Act read with Rule 18 of the Telangana Rights in Land and Pattadar Passbooks Rules, 1989, the petitioners are required to submit applications in Form VI(A) to the recording authority setting out the details on the strength of which they claim rights over the land in relation to which they seek mutation. Without submitting an application in the prescribed format, it is not open to the petitioners to complain of inaction on the part of the revenue authorities by making mere representations.
The Writ Petition is accordingly disposed of permitting the petitioners to submit their applications in Form VI(A) and in the event such applications are submitted along with the prescribed fee, the Tahsildar, Burgampahad Mandal, Bhadradri Kothagudem
District, shall consider the same on their own merits and in accordance with law and take appropriate action. Such exercise shall be completed expeditiously and in any event, not later than eight (8) weeks from the date of receipt of the applications in Form VI(A). Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _____________________ (SANJAY KUMAR, J) 4th June 2019 RRB
