THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.17353 OF 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings in Crime No.484 of 2016 on the file of Kacheguda Police Station, Hyderabad, registered for the offence punishable under Section 506 I.P.C.

During hearing, Sri B. Vijaysen Reddy, learned counsel for the petitioner, requested this Court to direct the police to follow the procedure contemplated under Section 41-A of Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR1 before effecting the arrest of the petitioner.

Acceding to the request of the counsel for the petitioner, the Police, Kacheguda Police Station, Hyderabad, are directed to follow the procedure contemplated under Section 41-A Cr.P.C. and the guidelines laid down by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR, referred to above, before effecting the arrest of the petitioner.
