HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2717 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in encouraging the encroachments and attempting to allot the house sites to the third parties, who are claiming as houseless poor, to an extent of Ac.0.40 cents situated in Chopparamannagudem Village of Koyyalagudem Mandal, West Godavari District, which were already assigned to the petitioners, without issuing any notice to the petitioners and conducting any enquiry, as arbitrary and illegal.

Learned Government Pleader for Revenue submits that the authorities will follow due process of law before taking any action against the petitioners in respect of subject lands. Recording the aforesaid submission of learned Government Pleader, the writ petition is disposed of directing the respondents not to dispossess the petitioners from the subject land without following due process of law. No order as to costs.
