HONOURABLE SRI JUSTICE P.NAVEEN RAO CRIMINAL PETITION NO. 26 OF 2015 ORDER:

Crime No.251 of 2013 of Narsingi Police Station, was registered against the petitioner/A1 for the offences punishable under Sections 399, 402 IPC and Section 27(1)(b) of Indian Arms Act. Aggrieved by order dated 31.12.2014, passed by the Metropolitan Sessions Judge in Crl.M.P.No.570 of 2014 in Crl.M.P.No.2545 of 2014 in Crime No.251 of 2013 of Narsingi Police Station Cyberabad at L.B.Nagar, the petitioner filed the present application under Section 482 of Cr.P.C. seeking relaxation with regard to imposing condition that the petitioner/A1 should be released on producing two local sureties with FDR's with Rs.10,000/- along with proof of identity i.e., Aadhar Card etc., for a like sum to the satisfaction of the VIII Metropolitan Magistrate, Cyberabad at Rajendranagar. Learned counsel for the petitioner submits that petitioner belongs to the State of Uttar Pradesh and hail from poor family and as such it is difficult for him to furnish two local sureties. As he is unable to secure local sureties, though bail was granted to him on 01.10.2014, the petitioner is not released.

The Additional Public Prosecutor opposed the prayer for modification of the conditions on the ground that investigation is not completed and the petitioner does not belong to State of Andhra Pradesh and if the conditions are relaxed, it is difficult to secure the presence of the petitioner/A1.

Having regard to the facts of the case, the order in Crl.M.P.No.570 of 2014 dated 31.12.2014 of the Metropolitan Sessions

Judge, Cyberabad at L.B.Nagar, is modified as under to the extent of securing two local sureties.

Petitioner/A1 is ordered to be released on bail on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties, one of which is local, for a like sum each with FDR's along with proof of identity i.e., Aadhar Card etc., to the satisfaction of VIII Metropolitan Magistrate, Cyberabad at Rajendranagar. The other conditions shall remain unaltered.

Accordingly, the petition is allowed.

As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
