HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.10168 OF 2015 ORDER :

No representation for the petitioners-accused Nos.1 to 5. Learned Additional Public Prosecutor for the State of Telangana would represent that the charge sheet was filed on 28.12.2016 before the Judicial Magistrate of First Class, Jagtial, and the cognizance as well as assigning calendar case number is awaited. It is almost more than two months over from the date of filing of the charge sheet. In fact, the learned Magistrate is obligated to examine the charge sheet and the annexures thereto and get any infirmities therein rectified or else has to take cognizance acting in accordance with law.

In view of filing of the charge sheet, the present petition is dismissed at the admission stage itself.

Miscellaneous Petitions, if any, pending in this petition, shall stand closed.
