THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.1523 of 2018 ORDER:

This revision petition is filed under Article 227 of Constitution of India challenging the inaction on the part of the trial Court to dispose of E.A.No.199 of 2016 in E.P.No.61 of 2016 in O.S.No.278 of 2007 on the file of the Court of Junior Civil Judge, Jammalamadugu.

A perusal of the record reveals that the petitioner filed O.S.No.278 of 2007 against the respondents seeking perpetual injunction. After full fledged trial, the trial Court decreed the suit on 28.04.2014. The petitioner filed E.P.No.61 of 2016 in O.S.No.278 of 2007. She also filed E.A.No.199 of 2016 in E.P.No.61 of 2016 seeking police protection. For one reason or other, the trial Court has not disposed of the said application.

At the time of hearing, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of E.A.No.199 of 2016 in E.P.No.61 of 2016 in O.S.No.278 of 2007 as expeditiously as possible. 4.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the learned Junior Civil Judge, Jammalamadugu, is hereby directed to dispose of E.A.No.199 of 2016 in E.P.No.61 of 2016 in O.S.No.278 of 2007 as expeditiously as possible, preferably, within a period of three months from the date of receipt of copy of this order.

With the above direction, the Civil Revision Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
