€u THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3248 ot 2021 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A'l seeking to grant anticipatory bail in the event of his arrest in Cr.No.762 of 2020 on the file of Saroornagar Police Station, Ranga Reddy District, registered for the offences punishable under Section 370(AXii) IPC and under Sections 3,4 and 5 of lT(P) Act, 1956.

Heard learned counsel for the petitioner/A'l , learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/A1 would submit that all the allegations made in the complaint are false and concocted and that there is no eyewitness to the incident as alleged by the prosecution and the petitioner has been falsely implicated in the crime. He further submits that the petitioner is not involved in any other crime prior to this occurrence and that the entire investigation is completed, except filing of the charge sheet. He also submits that the petitioner is a law abiding citizen and ready to abide by any condition that may be imposed by this Court in the event of his enlargement on anticipatory bail. 4.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner. However, he submits that the petitioner { l ') l is running a brothel house by engaging some other persons and that the charge sheet has already been filed in the present crime. 5.

Having regard to the facts and circumstances and in view of the nature of allegations leveled against the petitioner and since the charge t i )

\ { sheet has already been filed in the crime' and also in view of peculiar conditions of pandemic COVID-19 prevailing in the country, without delving into the merits of the matter' I am inclined to grant anticipatory bail to the petitioner/A'1 .

The Criminal Petition ls accordingly allowed and the petitioner/Al is granted anticipatory bail subject to the following terms and conditions: (i) The petitioner/A'1is directed to surrender before the Station House Officer, Saroornagar Police Station, Ranga Reddy District, within a period of 15 days from the date of this order and on such sunender, the said Station House Officer shall release the petitioner/Al on bail on his executing a personal bond to the tune of Rs.1,00,000/- (Rupees one lakh only) with tvvo sureties for the like sum each to his satisfaction.

(ii) On such release, the petitioner/Al shall appear before the lnvestigating Officer on 3'd Saturday of every month between 10.00 AM and 2.00 PM till completion of investigation and filing of the charge sheet, (iii) The petitioner/Al shall not indulge in any similar type of activities in future. lf he is indulged ln similar type of activities or involved in any other criminal cases in future, liberty granted to him shall stand cancelled automatically.

(iv) The petitioner/A'l shall abide by the other conditions stipulated in Section a3B(2) Cr.P.C.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
