THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.241 of 2011 JUDGMENT:

This appeal is filed by the defendant, under Section 100 CPC, assailing the judgment and decree dated 07.02.2008 in A.S.No.9 of 2003 on the file of VIII Additional District Court(Fast Track), Vijayawada, wherein whereby the decree and judgment dated 18.12.2002 passed in O.S.No.437 of 1993 on the file of I Additional Senior Civil Judge Court, Vijayawada, dismissing the suit filed by the plaintiff for declaration, was reversed. 2.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal.

Permission as sought for is accorded.
