THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1615 OF 2014 ORDER :

This writ petition is filed seeking to issue a writ of mandamus directing respondent authorities to consider representations dated 5-11-2013 and 9-12-2013 for issuance of D-form patta certificate in favour of the petitioner in compliance of Rule 11 of the AP Bhoodan and Gramdan Act.

The case of the petitioner is that he being a landless poor person and eligible for allotment of agricultural land by the 4th respondent-AP Bhoodan Yagna Board, made an application for allotment of agricultural land, and on such an application being made, the 4th respondent issued proceedings dated 28-5-1987 vide proceedings No.9472, for allotment of agricultural land in Sy.No.158 of Chippalapally village, Ranga Reddy District, admeasuring Ac.3-00 and communicated the same to the 3rd respondent-Tahsildar, Kandukur Mandal, Ranga Reddy District, for issuance of patta certificate. It is also stated that the 2nd respondent-District Collector, had also directed the 3rd respondent to submit detailed report with physical possession of the land for issuance of patta certificate and title deeds in favor of the petitioner. The petitioner states that he made representations to the 3rd respondent on 05-11-2013 and 09-12-2013 in relation to the subject matter, but till date no action has been taken on the said representations by the 3rd respondent. Hence, the writ petition. 3.

Heard learned counsel for the petitioner, learned Asst. Government for Revenue and learned standing counsel for 4th respondent.

A perusal of the docket proceedings, it is clear that on 06-02-2014, it was represented by the learned Government Pleader for Revenue that as per the orders of the District Collector, dated 4-8-2012, the 3rd respondent-Tahsildar has conducted detailed enquiry on the subject matter and submitted report, and orders of the 2nd respondent-District Collector awaited in the matter. Thereafter matter underwent adjournment for a couple of times awaiting for the orders of the 2nd respondent-District Collector. It is stated by learned counsel for the petitioner that till today no orders are passed by the 2nd and 3rd respondents. No counter affidavit is also filed by the respondents 2 and 3. 5.

Inasmuch as the grievance of the petitioner is only in relation to non-disposal of the representations said to have been filed by him on 05-11-2013 and 09-12-2013 on the subject mater, suffice it to direct 3rd respondent to consider the said representations and pass appropriate orders thereon, in accordance with law. 6.

The writ petition is disposed of with the above directions. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J Dated: 01-02-2017 Nrg
