Heard learned counsel for the petitioner and learned Standing Counsel for the fifth respondent.

The petitioner claims to be the absolute owner and possessor of an extent of Ac.1.26 cents of land situated in Survey No.764 /2A/1 of Penumatra Village and Mandal, West Godavari District, having purchased the same under registered sale deed dated 12.08.2009. The vendor was none-other than the cosine of the petitioner. The said property fell to the share of the vendor's father in a family partition effected on 02.09.1955. On 18.05.2017, the fifth respondent and other staff of the Gram Panchayat tried to interfere with the petitioner's possession. Hence, the present writ petition was filed. A counter affidavit is filed stating that the fifth respondent never interfered with the possession of the petitioner and that if at all they require any portion of his land, the respondents will follow due process of law.

In view of the statement made by the fifth respondent in the counter affidavit, it appears that the writ petition is filed on mere apprehension. Therefore, no further orders are required to be passed in this writ petition. The writ petition is accordingly closed. Consequently, miscellaneous petitions pending, if any, shall also stand closed.
