HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 21549 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as Fair Price Shop Dealer for Shop No. 36 of Madugupalli Village, Putlur Mandal, Ananthapur District. While so, impugned show cause noticecum-suspension order was issued against the petitioner on 9.6.2015. Challenging the same, the present Writ Petition is filed.
In the impugned order dated 9.6.2015 as many as five charges are levelled against the petitioner. The first charge
relates to variation in quantity of stock, whereas second charge relates to distribution 247 liters of kerosene oil for the month of June, 2015 instead of May, 2015 and took signatures in the sale register of the month of June, 2015. It is also alleged in Charge No. 3 that the dealer was not properly distributing the commodities. These charges require to be enquired into by the third respondent and therefore this Court is not inclined to interfere with the impugned order at this stage. In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to submit his explanation within fifteen days from the date of receipt of a copy of this order and third respondent shall complete the enquiry within thirty days thereafter by duly observing principles of natural justice. The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
