THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION Nos.4359, 4395 AND 4365 OF 2015 COMMON ORDER:

Crl.P Nos.4359 and 4395 of 2015 are come up for hearing today. When both the matters are taken up for hearing, the learned counsel for the petitioner informed this Court that Crl.P. No.4365 of 2015 is also connected with the above two cases and hence, Crl.P. No.4365 of 2015 is also disposed of along with the above said petitions.

All these Criminal Petitions are filed by the petitioners challenging grant of regular bail and anticipatory bail to the accused concerned, by the VII Additional Metropolitan Sessions Judge, Hyderabad, on the following grounds:

i.

At the time of granting bail, the injured was not discharged from the hospital;

ii. The learned Public Prosecutor has not brought to the notice of the learned Sessions Judge regarding the serious condition of the injured;

iii. The dying declaration recorded, taking into consideration that the injured is in serious condition, was not brought to the notice of the learned Sessions Judge by the Public Prosecutor iv.

Further, after obtaining bail, the accused are threatening the de facto complainant and his family members everyday.

Heard and perused the material available on record. Admittedly, the learned VII Additional Metropolitan Sessions Judge granted regular bails and anticipatory bails to the concerned accused in the year 2014. But, there is no specific mention about the threatening made by the accused and there is no complaint made by the de facto complainant about the threats made by them before the police concerned. But, taking into consideration the apprehension of the petitioners, this Court is of the view that these criminal petitions can be disposed of with the following condition:

All the accused, who were granted regular bail as well as anticipatory bail, are directed to be away from Hyderabad from 25.06.2015 and stay at Mahabubnagar for a period of (15) days and

report before the Mahabubanagar Town Police Station. Accordingly, all the Criminal Petitions are disposed of. ______________ RAJA ELANGO, J June 16, 2015 KTL
