ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos.2 and 3 in Crime No.216 of 2026 before the Malkajgiri Police Station, Malkajgiri District, registered for the offences punishable under

Sections 351(2), 115(2), 126(2) read with 3(5) of BNS and 3(1)(r)(s) and 3(2)(v)(a) of SC ST POA Act.

The brief facts of the case are that the de facto complainant lodged a report before the police on 12.03.2026 stating that he works as a car driver for a former Corporator and, about a week earlier, had driven a vehicle in the convoy of an MLA to Alwal. During the journey, another driver, Hemant Patel, overtook his vehicle at high speed. The complainant advised him not to drive recklessly as it could cause an accident. On 10.03.2026, at about 21:45 hours, the complainant went near Shiva Shakti Bar, Chanikyapuri Colony, Malkajgiri, for personal work. Around 21:50 hours, Hemant Patel called him to a function hall, abused him over the earlier incident, insulted him by referring to his caste, and assaulted him with his hands.

When the complainant questioned the assault, three others, Vamshi, Mareedu Rajashekar Reddy, and another unknown person joined in, beat him, and restrained him from leaving. As a result, the complainant sustained bleeding injuries to his mouth and nose. Hence, requested the police to take necessary action. Based on this report, the police registered a case against the accused for the alleged offences.

Heard Sri J. Vamshi Krishna, learned counsel appearing on behalf of the petitioners, and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners, arrayed as Accused Nos. 2 and 3, are innocent and have been falsely implicated and that the petitioners have no connection with the alleged offences and that the only allegation against them is that they joined Accused No.1 in beating the de facto complainant. Except for this allegation, there is nothing to attract the offences punishable under the SCs/STs (POA) Act. He further submitted that the petitioners are ready and willing to cooperate with the investigation and prayed the Court to grant prearrest bail to the petitioners by allowing the present Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions, contending that the allegations against the petitioners are severe and grave in nature and that the investigation is at a nascent stage and that custodial interrogation of the petitioners is necessary for effective investigation.

Accordingly, he prayed for dismissal of the Criminal Petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the only allegation against the petitioners is that they joined Accused No.1 in beating the de facto complainant. There are no specific allegations to attract the offences punishable under the SCs/STs (POA) Act against them. Considering the overall facts and circumstances of the case, this Court deems it fit to grant prearrest bail to the petitioners - Accused Nos. 2 and 3, subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Malkajgiri Police Station, Medchal Malkajgiri District within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m. for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
