HONOURABLE SRI JUSTICE P.NAVEEN RAO CRIMINAL PETITION No.2242 of 2019 ORDER:

The petitioners are accused Nos.1 to 9 in Crime No.15 of 2019 on the file of Rama Krishnapur Police Station, Ramagundam District. The said crime was registered based on the complaint lodged by the de facto complainant alleging that the accused have abused her, attempted to beat her on 02.3.2012. It was further alleged that on 03.12.2018 at about 9 pm., her brother-in-law, mother-in-law, sisters-in-law and their children trespassed into their house, abused and used filthy language. It was further alleged that an amount of Rs.10 lakhs lying in the bank account was illegally withdrawn.

Learned counsel for the petitioners submits that false allegations were made against the petitioners and that even though such incidents were stated to have occurred on 03.12.2018 and earlier, the crime was registered on 20.01.2019, which clearly indicates that it is a false complaint made only to harass and humiliate the petitioners. Learned counsel for the petitioners further submits that the petitioners would be satisfied if directions are issued to the Investigating Officer to strictly follow the law laid down by the Hon'ble Supreme Court in Arnesh Kumar vs. State of Bihar 1.

In view of the said submission, the Criminal Petition is disposed of directing the Investigating Officer to strictly follow the law laid down by the Hon'ble Supreme Court in Arnesh Kumar (supra) in the process of investigation into the aforesaid crime.
