Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.40 of Chennampalli Village, Pullalacheruvu Mandal, Prakasam District.
While so, the Food Inspector, Markapur, inspected the shop on 03.06.2015 and found marginal variations. Based on the report of the Food Inspector, 6-A proceedings were initiated on the same ground. The authorization of the petitioner was suspended by proceedings dated 06.06.2014 by the 4th respondent. Challenging the same, the present writ petition is filed.
3. Learned counsel for the petitioner submits that no show cause notice was issued before suspending the authorization or simultaneously with the order of suspension.
The present proceedings are initiated only on the ground that 6-A proceedings were taken against the petitioner.
This Court perused the allegations against the petitioner and noticed that some of the allegations are very trivial and the rest of the allegations are technical in nature. In the circumstances, the impugned order dated 06.06.2015 is set aside to the extent of suspending the authorization, but giving liberty to the 3rd respondent to conduct the enquiry into the allegations made against the petitioner and complete the same after giving due opportunity within a period of three months from the date of receipt of a copy of the order.
4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
There shall be no order as to costs.
