THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER W RI T PETI TI ON No.8 6 7 8 of 2 0 1 9 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking a Writ of Mandamus, directing the 3rd respondent/ Station House Officer, Kushaiguda Police Station, Rachakonda Commissionerate, to execute the Non-bailable Warrant issued against the 4th respondent by the learned XX Metropolitan Magistrate at Malkajgiri, Cyberabad.

2 .

Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Home representing the respondents 1 to 3 and perused the record.

3 .

It has been contended on behalf of the petitioner that the petitioner is being unnecessarily harassed, after being called to the police station. It is also contended that Non-bailable Warrant pending against the respondent No.4 is not yet executed. 4 .

The learned counsel for the petitioner could not substantiate before this Court that Non-bailable warrant is pending against the respondent No.4. Under these circumstances, no credibility can be given to other submissions. So, this writ petition does not merit consideration.

5 .

Hence, the Writ Petition is dismissed at the stage of admission. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ Dr . SHAMEEM AKTHER, J 24th April, 2019 Bvv
