THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.743 of 2013 JUDGMENT:

This appeal is filed under Section 100 CPC aggrieved by the judgment and decree dated 27.11.2012 in A.S.No.17 of 2009 on the file of the Court of Special Judge for Trial of Cases under SCs & STs (POA) Act-cum-Additional District Judge, Srikakulam, whereby whereunder the learned Judge reversed the judgment and decree dated 15.03.2008 in O.S.No.259 of 2005 passed by the Principal Senior Civil Judge, Srikakulam.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the second appeal and to that effect he also filed a letter dated 27.10.2017 before the Registry. Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
