THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7489 OF 2017 O R D E R :

This Writ Petition has been filed seeking a mandamus to declare the action of the respondents in trying to form a road without necessity and without acquiring the petitioner's land, as arbitrary and illegal.

Learned Standing Counsel for the 2nd respondent Municipality, based on written instructions, submits that the land of the petitioner in an extent of 45 Ankanams is located in Survey No. 1953 of Atmakur which is classified as the government land and is far away from the proposed cement road. He further submits that the municipal authorities never entered into the petitioner's land and in fact, there is no necessity for them to acquire the same.

Recording the said submissions, the Writ Petition is disposed of directing the respondent authorities not to interfere with the petitioner's land, except by following the due process of law. With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
