HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.14452 OF 2001 ORDER: (per the Hon'ble Sri Justice S.V.Bhatt) The petitioners pray for Mandamus declaring Memo No.CF/Misc.13/2001 dated 21.06.2001 issued by the 2nd respondent, as illegal, contrary to the principles of natural justice and provisions of the A.P. Chit Funds Act, 1971. At the time of hearing, the learned counsel for the petitioners places reliance upon the decision of this Court in MARGADARSI CHIT FUND PVT. FUND LTD., HYDERABAD V. THE STATE GOVERNMENT OF A.P to contend that the prayer in the instant writ petition is covered in favour of petitioner by this decision. The learned Government Pleader for Revenue on perusal submits that the issue is covered by the Division Bench judgment of this Court in MARGADARSI CHIT FUND's case (supra).

Hence, the writ petition is ordered in terms of the decision in MARGADARSI CHIT FUND's case (supra) and the impugned memo is set aside. There shall be no order as to costs.
