HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18728 OF 2017 ORDER:

This writ petition is filed challenging the action of the third respondent in contemplating to allot the petitioners' 'D-Form' patta land to an extent of Ac.1.21 cents in Survey No.69/4 of Sagipadu Village, Gopalapuram Mandal, West Godavari District, for the purpose of house sites without acquiring the said land and without paying any compensation.

Now a counter affidavit is filed by the Tahsildar, Gopalapuram, stating as follows.

"I humbly submit that I have not received any instructions from the higher authorities to dispossess the petitioners from their assigned land and moreover I have not contemplated to grant house site pattas to any weaker section people by dispossessing the petitioners from their land in D-Form patta measuring an extent of Ac.1.21 cents in R.S.No.69/4 of Sagipadu Village, Gopalapuram Mandal. If it is contemplated to happen, the entire procedure will be strictly followed as per the rules in force. It is submitted that the petitioner approached this Hon'ble Court basing on mere apprehension, without therebeing initiation of any proceedings. I submit that as and when the respondents intend to take steps as against the writ petitioners, without following due process of law, respondents will not take any action."

In view of the same, except recording the above statement of the third respondent, no further orders are required. The writ petition is accordingly disposed of.
