THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITIONS No. 25349 AND 25388 OF 2007 COMMON ORDER :

Though the petitioners challenge the action of the respondents in forcefully dispossessing them from the tenanted premises in the 1st respondent's building at Bedi Anjaneya Swamy Sannidhi Street, Tirumala, learned counsel appearing for them, now, on instructions, submits that his clients do not wish to press the relief claimed in both the Writ Petitions. However, submits the learned counsel that certain valuable goods belonging to the petitioners were seized on 25.06.2007 and were kept under the custody of the 3rd respondent, hence, the same may be directed to be released.

In the counter-affidavit filed by Respondents 2 and 3, in paragraph 8, the allegation of the petitioners that articles worth Rs. 3 lacs were removed by the respondents has been denied. Learned Standing Counsel for the respondents, on instructions, however, submit that if the petitioners approach the respondents, they would hand over the goods.

Recording the said submission made by the learned Standing Counsel, both the Writ Petitions stand disposed of, directing the respondents to hand over the seized goods within ten days of the petitioners approaching them seeking its release. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.

Learned Standing Counsel appearing for the respondents shall inform the order passed now to the respondents, to avoid logistical delay.
