HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19888 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The petitioner was appointed as a fair price shop dealer of Kesaripada Village, Kanchili Mandal, Srikakulam District, in the year 1993. Her authorization is valid upto 31.03.2015. While so, on 20.08.2014, the fourth respondent inspected the fair price shop of the petitioner and noticed some irregularities. Based on the report of the fourth respondent, the third respondent issued show cause notice dated 08.09.2014. Since the authorization of the petitioner was not suspended, and as the respondents were not supplying essential commodities, the petitioner filed W.P.No.29339 of 2014. This Court, by order dated 26.09.2014, directed respondent Nos.3 and 4 to supply stock so long as the authorization of the petitioner subsists and directed the third respondent to pass final orders. The third respondent passed final orders on 27.12.

2014 cancelling the authorization of the petitioner. Against which, the petitioner filed W.P.No.13710 of 2015. By order dated 01.06.2015, this Court disposed of the Writ Petition granting liberty to the petitioner to prefer an appeal within thirty days. Pursuant to the order of this Court, the petitioner filed an appeal, along with a stay petition, on 15.06.2015 before the second respondent. When no orders were passed on the said stay petition, the present Writ Petition is filed. In view of non-disposal of the stay petition, learned Counsel for the petitioner submits that the petitioner is not in a position to draw stock.

In the circumstances, the second respondent is directed to

consider and dispose of the stay petition filed by the petitioner on 15.06.2015 within a period of one week from the date of receipt of a copy of the order.

The Writ Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous applications, if any, also stand disposed of.
