In the present writ petition the petitioner herein is seeking a direction to the 1st respondent corporation - State Government to dispose of the appeal filed by the petitioner on 08-02-2016 against the order passed by the Commissioner of Intermediate Education, Andhra Pradesh, Hyderabad vide Rc.No.Admn.II-1/9670/2015, dated 10-11-2015.
Heard Sri S.A.K. Mynoddin, learned counsel for the petitioner and learned Government Pleader for Education for respondents.
According to the petitioner, he belongs to Scheduled Caste and he was appointed as Junior Lecturer in English in 3rd respondent college on 19-11-1990 and served the institution till 1703-2009 as Junior Lecturer and due to certain personal reasons he resigned to the said post w.e.f., 17-03-2009. It is further stated that subsequently on 11-12-2010 the petitioner made a representation to the 3rd respondent to permit him to withdraw his resignation and join into service. Earlier the petitioner herein filed W.P.No.29876 of 2015 questioning the action of the respondents in not considering his representations, dated 11-12-2010, 11-02-2012, 02-11-2014 and 25-06-2015, wherein he requested for withdrawal of the resignation.
This Court, on 15-09-2015, passed an interim order,
directing the respondents to consider the said representations and to pass appropriate orders within a period of eight (8) weeks from the date of receipt of the order. Thereafter the 2nd respondent herein vide proceedings Rc.No.Admn.II-1/9670/ 2015, dated 10-112015 rejected the request of the petitioner herein. As against the said order of rejection passed by the 2nd respondent the petitioner herein claims to have filed a revision under Section 90 of the A.P. Education Act, 1982. The grievance of the petitioner in the present writ petition is non-disposal of the said revision by the 1st respondent.
It is further submitted by learned counsel for the petitioner that in view of the said inaction on the part of the 1st respondent in disposing of the revision the petitioner herein is suffering irreparable loss and hardship.
Having regard to the nature of controversy and in the facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if the 1st respondent is directed to dispose of the appeal, dated 08-02-2016 said to have been filed by the petitioner herein against the orders of the 2nd respondent vide Rc.No.Admn.II-1/9670/2015, dated 10-11-2015 by fixing some time frame.
For the aforesaid reasons, the writ petition is disposed of, directing the 1st respondent - State Government to pass appropriate orders on the revision, dated 08-02-2016 said to have been preferred by the petitioner herein against the orders of the
2nd respondent vide Rc.No.Admn.II-1/9670/ 2015, dated 10-112015, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order by giving notice and opportunity of being heard to the petitioner herein. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
