SMT. JUSTICE T.RAJANI MACMA. No.467 of 2006 JUDGMENT:

This appeal is preferred by the appellant, who is claimant before the lower Court, dissatisfied with the award of the IV Additional Chief Judge, Hyderabad passed in O.P. No.1594 of 2003 on 08.08.2005 by virtue of which, the lower Court awarded Rs.25,000/- as against the claim of Rs.1,00,000/- made by the claimant. The grounds on which, the appeal is preferred are that the lower Court ought to have awarded more compensation by considering that the petitioner had sustained grievous injuries and the Court awarded compensation without discussing anything about the expenditure incurred by the petitioner. Heard the learned counsel appearing for the appellant and the 2nd respondent and perused the material on record.

At the hearing, the learned counsel for the appellant could not put forth any additional grounds or material on the basis of which the award made by the lower Court can be interfered with. Ex.A-3 is the only document filed by the claimant in proof of his injuries, which is the medical certificate showing one laceration 6x1 cm., over the right arm and bleeding through the nose. Except the above, there is absolutely no material placed by the claimant with regard to any consequences which resulted from the injuries or any further loss. Hence, the award of Rs.25,000/- made by the lower Court in the light of Ex.A-3, medical certificate, showing only two injuries cannot be found fault with, as it is more than adequate. Hence, absolutely no interference is required in the award of the lower Court.

For the above reasons the appeal is liable to be dismissed and is accordingly, dismissed. There shall be no order as to costs. Consequent to dismissal of the appeal, miscellaneous petitions, if any, pending in this appeal, shall stand closed. ____________________ JUSTICE T.RAJANI Date: 30.06.2017 LSK
