THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1562 of 2015 ORDER:

The limited grievance of the petitioners is that as against the orders passed by the 4th respondent-Tahsildar in RCC No.405/98 dated 19.12.2000 under the A.P. (A.A) Inams (Abolition and Conversion into Ryotwari) Act, 1956 (for short 'the Act'), an appeal was preferred before the Revenue Divisional Officer on 25.04.2013 but the appeal is not yet disposed of.

Learned Assistant Government Pleader, on instructions, submits that though the appeal was received in the Office of the Revenue Divisional Officer on 25.04.2013, the same was returned with objections on 10.05.2013 and thereafter, the petitioners complied with certain objections and re-presented the appeal on 29.05.2013. Considering the fact that the objections raised were not fully complied with, the appeal was again returned.

3. On the other hand, Sri T.V.S. Prabhakar, learned counsel for the petitioners, placing reliance on the letter dated 06.08.2014 addressed to the Revenue Divisional Officer by Sri S. Gopaiah, Advocate on behalf of the petitioners herein, submits that the papers returned by the Revenue Divisional Officer were re-presented on 06.08.2014 and the objections raised have been answered. It is the submission of the petitioners counsel that the Revenue Divisional Officer neither accepted the appeal nor communicated the reasons for not accepting the appeal in writing. Returning of the appeal papers without dealing with the contentions raised and explaining the objections is not proper inasmuch as the petitioners would be prevented from pursuing the remedies available under law.

5. In that view of the matter, the petitioners are given liberty to

submit the appeal papers, if not already submitted; whereupon the 3rd respondent is directed to receive the appeal papers and communicate the decision on the same, in writing. This exercise shall be completed within two weeks from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
