HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3017 OF 2015 O R D E R :

This petition is filed for a writ of Mandamus declaring the seizure of the petitioners' vehicles Tractor & Trailer bearing Nos. AP 15 TC 3993 & AP 15 AP 6853 and AP 15 TA 8900 & AP 15 TA 8901 as illegal and arbitrary and for a consequential direction to the respondents to release the said vehicles. Heard learned counsel for the petitioners who submits that in similar circumstances this Court has disposed of WP.No.1219 of 2015 on 05.02.2015 and the lis in the present writ petition is squarely covered by the above said order dated 05.02.2015. Learned counsel for the respondents also not disputed the same. Recording the above submission, the writ petition is disposed of in terms of the order dated 05.02.2015, passed by this Court in WP.No.

1219 of 2015, directing the respondent authorities/concerned Officer either to immediately take steps in compliance of sub-rule (1) of Rule 13 (3) by preparing seizure report and produce the vehicles before competent Court to enable the petitioners to file an application under Section 451 Cr.P.C, for release of their vehicles, whereupon the competent Court shall pass orders in accordance with law; or, if the authorities fail to produce the same before the competent Court forthwith, the petitioner be permitted to submit a representation to the concerned officer seeking release of their vehicles.

seeking sufficient security for production of vehicles as and when required. The 2nd respondent shall take necessary action in respect of sand, as per Rule 14 of the Telangana State Sand Mining Rules, 2015 framed in G.O.Ms.No.3, dated 08.01.2015. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
