HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25291 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer. On a surprise check by the Vigilance and Enforcement Department, a shortage of PDS rice of 4.91 qtls. was noticed, and seized the stock, and submitted a report for initiation of 6A proceedings. The petitioner states that she preferred an appeal to the second respondent. The present Writ Petition is filed seeking supply of stock so long as her authorisation is in force. It is needless to mention that, so long as the authorization of the petitioner is in force, she is entitled for supply of stock.

However, learned Government Pleader for Civil Supplies has not produced any evidence to show that the petitioner's authorization was suspended, and any action was taken against her. In the circumstances, the Writ Petition is disposed of directing the respondents to release the stock to the petitioner for distribution to the cardholders so long as her authorization is in force.
