HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1439 OF 2009 ORDER:

This writ petition is filed for a Mandamus declaring the action of the respondents in interfering with the petitioner's construction in Sy.No.47/C abd 47/D, situated at Sitharampur Village and Gram Panchayat of Karimnagar Mandal and District, pursuant to the application of the petitioner dated 23.07.2007, as arbitrary and illegal and for a consequential direction to the respondents not to interfere with the construction work of the petitioner.

This Court while admitting the writ petition on 09.02.2009, granted interim direction to the effect that the respondents shall not interfere with the construction undertaken by the petitioner as long as it accords with the plan and does not violate any building bye-laws.

By afflux of time and by virtue of the interim order passed by this Court, the petitioner has completed the construction and as such, the respondents shall not interfere with the same. But, however, it is open for the respondent authorities to take action if the petitioner has committed any violations by following due process of law.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any
